1. Introduction

These Terms and Conditions («T&Cs») outline the rules and regulations for shipping and returns for purchases made through the Yuh Merchandising Shop («Yuh», «Shop», «we», «us», or «our»). By placing an order, you accept these terms in full. Please ensure that the delivery address and telephone number provided are correct and complete. Yuh is not liable for any delays or non-deliveries due to incorrect or incomplete addresses. We reserve the right to change product specifications without prior notice.

2. Product & Price

Images of products in advertising, brochures, the Shop, etc. are for illustrative purposes only and are not binding.

All sales prices published in the online shop are final prices that include all taxes (in particular VAT), costs for packaging, delivery costs and any other costs, unless otherwise specified in these T&Cs.

3. Conclusion of contract

The products and prices in the Shop are considered an offer. However, this offer is always subject to the condition subsequent to the contract of an inability to deliver or an incorrect price.

The purchase contract for products comes into effect as soon as you place your order in the Shop, by phone or email (the «purchase contract»).

4. Payment

4.1. Payment Options

Customers have access to the payment methods offered in the online shop under «Payment Options». Purchasing on invoice is only possible upon agreement with Yuh.

The current payment method fees, which may be charged by Yuh, will be detailed during the order process.

When paying by debit card, credit card or other instant payment methods, the charge of the price will be made at the time of ordering.

If advance payment methods are offered, delivery will only be made after receipt of payment. Products are reserved for at least 14 calendar days until the payment deadline expires.

4.2. Default of Payment

If the customer fails to meet its payment obligations in whole or in part, all outstanding amounts owed to Yuh under any title will become immediately due (in the case of advance payment, within 8 calendar days of the first reminder), and Yuh may demand these amounts and suspend further deliveries to the customer.

Yuh charges an administration fee of CHF 20 for the second reminder and CHF 30 for the third reminder. If the reminders are unsuccessful, the invoice amounts may be assigned to a debt collection agency. In this case, an effective annual interest rate of up to 15% may be charged on the outstanding invoice amount from the due date. The debt collection agency will pursue the outstanding amounts in its own name and for its own account and may charge additional processing fees.

4.3. Retention of Title

Ordered products remain the property of Yuh until full payment is received. Yuh is entitled to make a corresponding entry in the retention of title register. Before the transfer of ownership, any pledging, transfer of ownership by way of security, processing, or transformation without the express consent of Yuh is not permitted.

5. Shipping Policy

5.1. Shipping Locations

  • Shipping is only available within Switzerland and Liechtenstein. Shipping abroad is not possible.
  • Orders to PO boxes or military addresses are not supported.

5.2. Shipping Costs

  • Shipping fees are included in the price of the product.

5.3. Processing Time

Orders are processed on a best efforts basis (excluding weekends and holidays) from the time of purchase. Order execution depends on product availability. Products may be shipped in multiple packages. Delays may occur during peak seasons or due to unforeseen circumstances.

5.4. Delivery Timeframes

  • Items are delivered within 2 - 5 working days. Estimated delivery times are not guaranteed and may vary due to external factors.

5.5. Order Tracking

  • You will receive confirmation upon receipt of your order, and a tracking number via email once your order has shipped.

5.6. Failed Deliveries and Re-shipments

  • If a delivery fails due to incorrect address information provided by the customer, additional shipping charges may apply. Items returned to us due to failed delivery attempts will incur a restocking fee.

5.7. Risk of Loss

  • All items purchased are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

6. Returns Policy

6.1. Eligibility for Returns

  • Items are eligible for return within 14 days of receipt, provided they are unused, unworn, unwashed, and in the original packaging with all tags intact. Non-returnable items include used items.

6.2. Return Process

  • Check delivered goods immediately upon receipt. To initiate a return, please contact us via the contact form within 7 days of receipt with your order number and reason for the return. In exceptional cases, items may be returned in their original packaging and in perfect condition after prior consultation. Returns must be made within 14 days of receipt.

6.3. Return Shipping Costs

  • Return shipping fees are the responsibility of the customer unless the return is due to a defect or error on our part. We recommend using a trackable shipping method for returns, as we are not responsible for lost or undelivered returns.

6.4. Refunds and Processing Time

  • Once your return is received and inspected, we will send you an email notification. Approved refunds will be processed to the original method of payment within best efforts business days. Refunds for non-defective items exclude shipping and internal costs. If the returned item is not in resalable condition, we may refuse a refund or deduct up to 20% of the original price.

6.5. Exchanges

  • Exchanges are subject to availability. To exchange an item, please contact us via the contact form with your order details. We will reserve the replacement item and ship it upon receipt of the original item.

7. Warranty and Inspection of Goods

  • You are required to immediately check delivered or collected products for correctness, completeness, and delivery damage. If you receive a damaged or defective product, please contact us within 7 days of receipt with photos and a description of the issue. Return damaged items with a note stating your name, order number, reason for return, and the requested action. Depending on availability, a replacement will be delivered, or the costs will be refunded.
  • The statutory warranty for defects applies. We expressly reserve the right to supply the buyer with a defect-free replacement in the event of asserted and established defects in the purchased item.

8. Liability

Liability is governed by the applicable statutory provisions. However, we are in no event liable for (i) slight negligence, (ii) indirect and consequential damages and lost profits, (iii) unrealised savings, (iv) damages resulting from delayed delivery, and (v) any acts or omissions of our agents, whether contractual or non-contractual.

9. Data Protection

10. Partial Invalidity

Should individual provisions of these T&Cs be invalid or ineffective, this shall not affect the effectiveness of the remaining provisions and these T&Cs.

11. Amendments to These Terms

We reserve the right to update or modify these Policies at any time without prior notice. Changes will be posted on this page with the date of revision indicated.

12. Place of jurisdiction and applicable law

The legal relationship between Yuh and the customers of the Shop are subject exclusively to Swiss law. The Vienna Sales Convention is not applicable.

For all claims arising from sales contracts, the place of jurisdiction for lawsuits brought by consumers is their domicile or Gland. In all other cases, Gland is the exclusive place of jurisdiction.
